 REPUBLIC ACT 5487 (Private Security Agency Law) RULE XVII - Administrative Sanctions Part 2 - Sanctions Against Licensed Security Personnel


Sec. 3. Classification of Offenses.

a. Light offense shall include, but not limited to those related to uniforms, use of profane languages, acts of discourtesy, failure to notify/call the nearest PNP station in case of disorder, riot, strike, and other emergency cases. lateness or failure to maintain and/or submit records/reports,

violation of section 1, Rule X of these rules and regulations otherwise not specifically falling under this provision,

all acts of (sic) prejudicial to good conduct, behavior, morals, and similar acts,  pursuant to existing laws, rules, and regulations.


b. Less grave offenses shall include, but not limited to

not having in possession duty detail order and/or license to posses firearms (when carrying firearm) while performing private security service,

use of uniform not appropriate for one's rank or position,

leaving his/her post without being properly relieved, thus exposing the lives and properties he/she is supposed to protect from danger,

indiscriminate firing of firearm;


c. Grave offenses shall include, but not limited to

using uniforms other than what is prescribed under these rules,

using personally owned firearm or firearm not licensed to the security agency during the tour of duty,

allowing the use/lending issued firearms to unauthorized persons,

assisting, abetting or protecting criminals during on or off duty,

providing confidential information to unauthorized person/s,

refusal to provide information to authorized person/s,

illegal search,

taking alcoholic beverages or being drunk while on guard duty,

abuse or acting beyond the scope of authority,

misrepresentation in the submission of documents fro renewal of license,

using fake license, a document issued by and/or secured from sources other than SOSIA;


d. Fake License - A document issued by and/or secured from sources other than SOSIA.


Sec. 4. Penalties - Without prejudice to the filing of appropriate criminal action, the following penalties shall be imposed after investigation of any private security personnel, thereafter found guilty of committing any of the offenses previously enumerated in Section 3 of this rule:


A. Light Offenses - One to 30 days suspension or a fine ranging from one hundred pesos minimum to five hundred pesos maximum or both;


B. Less Grave Offenses - One month and one day to six months suspension or a fine ranging from five hundred pesos minimum to one thousand pesos maximum or both; and


C. Grave Offenses - Six months and one day to one year suspension or a fine of ranging from ten thousand pesos minimum to fifty thousand pesos maximum or both and/or cancellation of license/permit.


Sec. 5. Status During Suspension - ​the Agency shall provide a substitute guard the post of the suspended guard in order not to prejudice the interest of its client. Provided, that the service of the substitute guard shall be good only during the period of such suspension.
